Well, it applies, just that, in her opinion, it only applies to
federal educational programs. Which means that no government
agency can charter a traditional unit.
Also note that some school districts are now forbidding the Scouts
from soliciting in the schools (no more recruiting or
distributing material inside schools). see

What ever happened to that study we were suppose to do after the
