A similar discussion came up a few months ago on the list.
The badges and insignia and certain terminology are
exclusively granted to the BSA and protected by the
Congressional Charter. This is supposed to be better than a
copyright since copyrights expire from time to time and the
Charter doesn't. AFAIK you never see a copyright or
trademark symbol next to the term "Boy Scout" or associated
with the scouting badges and emblems.
Of course, every rule has an exception and I have seen
copyright symbols appear lately that are associated with
certain Venturing logos.
Maybe one of the attorneys on the list can weigh in on this
As far as use of the insignia, or copying manuals and
documents, I always ask my CSE for permission. That's
because he always says yes :-)
Of course, he is also the one who told me he is authorized
give those permissions :-)
I think a quick phone call to your Council's Service Center
would resolve the use of the badge for your Eagle COH.
But, I could be wrong and this is the Internet and it's
always a good idea to validate the information you acquire
