Actually, it wouldn't be a direct violation of BSA policy unless it was
absolutely clear from the uniform and insignia that members of the BSA were
pictured (anyway, I think this is right, I haven't dealt with this for a
very long time). Picturing youth who "look like Scouts and act like Scouts"
is not the same as actually picturing Scouts.
As I said, I haven't dealt with this for a while so I might be a little
rusty. I believe that it is likely the National already knows about this
commercial, and has probably decided that the images do not infer a BSA
endorsement. It's important to realize that the BSA has been dealing with
the use of BSA images and such in advertising since the beginning. Most of
the folks involved in advertising (or at least their lawyers) know that
organizations like the BSA have policies concerning endorsements. That's why
the commercial doesn't use any obvious BSA symbols or emblems. I'm also sure
that the BSA makes sure that information about the commercial use of BSA
symbols and emblems is readily available. I know that major corporations
spend quite a bit of money every year buying advertising space in trade
magazines just to remind writers that certain words need to be presented in
a certain way.
