I've been known to disagree with Mike Walton from time to time but I think
his response on the Eagle BOR question was right on. His approach did not
assume that the individual was guilty but, instead, used the incident as
the basis for a discussion about scout spirit, etc.
The unfortunate issue is that the "victims" don't seem to be satisfied
with the results of the judicial process. However, it is not BSA's place
to judge the courts. The case has apparently been resolved in the courts
and that's where it should remain in terms of legal actions.
On eagle boards, I often ask questions related to incidents in the news
and ask the scout to tie his demonstration of scout spirit to the incident.
The fact that the scout was probably involved in the incident doesn't make
any difference to me. I'm looking for the scout's demonstration of scout
There is the PR issue with the "victims." I'd look to the professional
staff to deal with that issue since the letter was apparently sent to the
council rather than the unit.
