I'd heard not so long ago that ASCAP had toned this down somewhat,
because originally they had even started to go after people singing the
traditional version of "Happy Birthday."
Apparently, that is the problem right there: what is in the public
domain? ASCAP would have us believe that darn near everything is...and
no one has tried to take them on in this yet.
The safest thing, as mentioned earlier, is to go with scout songs, or
songs in a scout songbook. If ASCAP is getting active on this again, it
may be time to start doing "background checks" on the some of the other
songs we sing.
