A lot of you may have been following the flap in the press about the
administration's plans to begin regulating the availability of tobacco
products (and the advertising of such) to youth.
Well, in case anyone is interested, the August 11 Federal Register
contains a several-hundred page legal analysis of the Food & Drug
Administration's jurisdiction over this issue, as well as a copy of
that agency's proposed rule to regulate these products as drug (i.e.,
nicotine) delivery devices.
Being the flack/policy wonk that I am, I will try to look these items
over and summarize them for the list over the next few days.
For those of you interested in looking at these items personally--and
I know there must be hundreds of you on this list :<)--you can usually
find microfiche copies of the Federal Register in your public or local
university library. The issue is August 11, pp. 41314-41451 (the
proposed rule) and pp. 41453-41787 (legal analysis re FDA's
