That's not really the point here, Bob. The point is that even in successfully
defending or appealing this type of a case, the costs are significant.
Let's turn the question around a bit. How many times have you heard of an
"innocent" party either settling out of court, or plea barganing to a lesser
charge, because the cost of defending ones-self is higher than the cost of the
settelment? It happens to businesses all the time. Pay the plaintiff $50K,
and settle out of court, or pay your lawyer X times $50K defending you.
The BSA has spent hundreds of thousands of dollars on legal defense. Regardless
of whether the BSA wins or loses, they (we) lose because that money is not spent
where it is needed.
