Nathan, given what you alluded to about this guy's history, your concerns
regarding youth protection and your sense of urgency, I think the first thing
you HAVE to to do is get him away from the program, ASAP! Tell this guy, in no
uncertain terms that he is not wanted or needed by BSA or any organization.
Dump him and then go about officially getting him out of OA, BSA and his merit
badge duties. Don't cut him any slack. He won't fight it, publicity ya know.
He won't go away, these guys lurk around to see if you will stick to your
guns. Without opening yourselves up to any legal implementations, let him know
that you want him out and will make sure he never will be involved with Scouts
in any capacity ever again.
Believe it, these guys are tenacious and just never seem to go away when
treated with kid gloves. As one who unfortunatley had to find out the hard
way, take it upon yourselves to protect your kids, the legal system won't do
it. Your question was "do we have a leg to stand on"? You do, your own two
feet. Do what it takes to get him out of there.
Don't ever take chances with your boys, or yourselves regarding the issue of
